| Swift Trans. has implemented a rule that drivers must show 15 minutes driving time for any qtr. hour that they drive in, even if it is only 1 minute in the qtr. If you stop driving at 12:01 you show driving from 12:00 to 12:15. 395 does not address the issue other than 395.8 says you have to accurately log all 24 hours on a daily log. Legal opinions from an attorney advises this requires the system used by any company must be as accurate as possible. Since the hours are logged in qtr. hour increments, the most accurate way would be rounding to the nearest qtr. hour. Over a 7 to 8 day period the round ups and round downs would more accurately reflect the actual time to the minute than any other system. If anybody knows of court cases, rules, regulations, or laws that require this please advise. |

What a waste of your driving time I can see doing that if you stopped at 12:12 or later. But for 1 minute that's BS and there is also a 7 and 8 minute rule. You can also use this to your advantage If this is the way they want you to do it then do it. And at the end of the day when they want you to do something " sorry not enough hours". This will come back to bite them in the ass. Use that logbook to benefit you and it can be your best friend or worst enemy  _________________

In all my years of driving and with every company I've driven for the policy has been to round it off to the nearest quarter hour...
It doesn't surprise me that Swift wants their drivers to do it this way. Ever since they nearly lost their operating authority due to poor safety stats a few years back they've been kissing the D.O.T.'s azz. Electronic Logging is best anymore especially with the CONFUSING 11/14 crap.
I log pre-trips at 15 minutes regardless of how long it actually takes, AND I'm usually doing random enroute checks till I go to sleep which negates a post trip check of which I'll log sometimes ONLY when such will not overstep available hours.
When dealing with federal stupidity like such rounding off, one has to see how such is done by the many differing constructs:
In unemployment stuff with the cent deal they round UP when at say $.49, whereas others round DOWN when at say $.49
On Taxes, they want to round UP from a nickle, so go figure.
When something costs, for example, $3.09, I'm NOT PAYING $4.00
In regards to log book figurings, whenever I log, I have followed the ruling of the F.M.C.S.R. REGARDLESS of how some (idiot) company otherwise wanted such rounding off done.
Since swift wants such rounding off a certain way, let them approach the F.M.C.S.R. and challenge such stipulations OR you can simply DO SUCH GOOFY ROUNDING OFF and as such BE OUT OF DRIVING HOURS QUICKER.
It'll certainly both HELP and HINDER your productivity levels.
